Terms of Service

Welcome to ProveIT. By using the ProveIT mobile application and the proveit-app.com website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Overview

ProveIT is a media authentication platform that allows users to capture photos and videos, cryptographically verify their authenticity, and share verifiable proof that media has not been altered. The Service includes a mobile camera application, a verification website, blockchain-based proof of authenticity, and related features and services we may introduce from time to time.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian.

3. Accounts

  • You may use the Service anonymously with limited features, or create an account with an email address for full access.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate information and keep it up to date.
  • You may not impersonate another person or use a misleading username.
  • Account usernames, display names, and email addresses may only be changed once every 30 days.
  • We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, verify, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Distribute child sexual abuse material (CSAM) or content that exploits minors.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation.
  • Attempt to circumvent, reverse-engineer, or manipulate the verification process or any security measures.
  • Interfere with or disrupt the Service, servers, or networks.
  • Use automated systems (bots, scrapers) to access the Service without prior written permission.
  • Attempt to gain unauthorized access to other users' accounts, data, or systems.
  • Use the Service in any manner that could damage, disable, overburden, or impair it.
  • Violate any applicable local, national, or international law or regulation.

5. Content Ownership & Licensing

  • Your Content: You retain full ownership of the photos and videos you capture. ProveIT does not claim any intellectual property rights over your content.
  • License to ProveIT: By verifying and uploading content, you grant ProveIT a non-exclusive, worldwide, royalty-free license to store, process, reproduce, and display the content as necessary to operate, maintain, and improve the Service (e.g., showing it on the verification page, storing the hash on the blockchain, generating thumbnails, and performing image analysis for verification purposes).
  • Public Verification: Verified captures have a public verification page accessible to anyone with the three-word code, verification link, or hash. This is by design and integral to the Service. You acknowledge and agree that verified captures constitute a voluntary publication.
  • Attribution: If you opt in to public attribution, your username will be displayed on the verification page. You can control this on a per-capture basis.
  • Feedback: Any feedback, suggestions, or ideas you submit about the Service may be used by us without obligation or compensation to you.

6. Subscriptions & Payments

  • Certain features of the Service may require a paid subscription. Subscription plans, pricing, and features are described within the app and may change from time to time.
  • Payments are processed through third-party payment providers (e.g., Apple In-App Purchase). You agree to abide by the terms and conditions of the applicable payment provider.
  • Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can manage or cancel subscriptions through your device's app store settings.
  • Refunds are handled in accordance with the policies of the applicable app store or payment provider.
  • We reserve the right to modify subscription pricing with reasonable notice. Price changes will not affect the current billing period.

7. Verification & Blockchain

  • ProveIT verifies that a photo or video has not been altered since the moment of capture within the app. It does not verify the truthfulness, accuracy, or context of the content depicted.
  • Cryptographic hashes of verified captures may be recorded on a public blockchain. Blockchain records are permanent and cannot be deleted or modified.
  • The three-word code and verification page provide a convenient lookup, but the blockchain record serves as the ultimate proof of authenticity.
  • We may change the blockchain network, verification methods, or cryptographic standards used by the Service at our discretion, provided such changes maintain the integrity of existing verifications.

8. Content Moderation

  • We reserve the right to review, hide, or remove any content that violates these Terms, at our sole discretion.
  • Users may report content or profiles they believe violate these Terms.
  • Accounts that repeatedly violate these Terms may be suspended or permanently banned.
  • Moderation actions on our servers (hiding content, suspending accounts) do not affect blockchain records, which remain immutable.
  • We may use automated tools and human review to detect and address policy violations.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.

10. Third-Party Services

The Service may contain links to or integrations with third-party websites, services, or content that are not owned or controlled by ProveIT. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

11. Intellectual Property

The Service, including its design, branding, logos, software, and documentation, is owned by ProveIT and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology without our prior written consent. These Terms do not grant you any rights to use ProveIT's trademarks, logos, or branding.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • Verification results are infallible — while we use robust cryptographic methods, no system is immune to all forms of manipulation.
  • Blockchain networks will remain operational or accessible indefinitely.
  • The Service will meet your specific requirements or expectations.

13. Limitation of Liability

To the maximum extent permitted by law, ProveIT and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or use, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless ProveIT and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.

15. Account Deletion

  • You may delete your account at any time from the app's Profile settings. This requires password verification.
  • Upon deletion, your personal data (profile, email, display name, avatar, device registrations) is permanently removed from our servers.
  • Unverified captures and their associated files are permanently deleted.
  • Verified captures are anonymised — your personal identifiers are removed, but the verification record, three-word code, and public verification page are retained. You chose to verify and publish each capture, and these records exist independently of your account.
  • Blockchain records are immutable and cannot be deleted.
  • Active subscriptions should be cancelled through your app store settings before deleting your account. Account deletion does not automatically cancel external subscriptions.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitations of liability) shall survive.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page, updating the "Last updated" date, and where appropriate, notifying you via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

18. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ProveIT operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the competent courts of the jurisdiction in which ProveIT operates.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ProveIT regarding the Service and supersede any prior agreements or understandings.
